1. About These Terms

These Terms of Service ("Terms") apply to your access to and use of The Sights website, event galleries and related services.

In these Terms, "The Sights", "we", "us" and "our" refer to the operator of The Sights. "You" and "your" refer to anyone who accesses or uses the service, including event hosts and guests.

By creating an account, purchasing an event, uploading content or otherwise using The Sights, you agree to these Terms.

2. The Sights Service

The Sights is an online event photo-sharing service that allows an event host to create an event gallery and invite guests to contribute photos using an event link, event code or QR code.

Guests may upload photos to an event without creating a The Sights account.

Event hosts can access their event gallery and download photos contributed to their event.

Features, functionality and availability of The Sights may change over time as the service is developed and improved.

3. Accounts

Event hosts may be required to create an account to create, purchase and manage events.

You are responsible for providing accurate information and keeping your account credentials secure.

You are responsible for activity carried out through your account unless that activity results from circumstances outside your reasonable control.

You should contact us if you believe your account has been accessed without your permission.

4. Event Access and Sharing

Each event may have a unique event code, link and QR code that can be shared with guests.

Event hosts are responsible for deciding who receives this information.

You must not deliberately attempt to access an event, account or gallery that you are not authorised to access.

5. Uploading Photos and Content

Event hosts and guests may upload photos and other content supported by The Sights.

You retain any ownership rights you have in content you upload. The Sights does not claim ownership of your event photos.

By uploading content to The Sights, you give us permission to store, process, display and make that content available through the relevant event to the extent reasonably necessary to provide the service.

This permission does not give The Sights the right to use your event photos for unrelated advertising or promotional purposes.

6. Your Responsibilities for Uploaded Content

You are responsible for content you upload to The Sights.

You must not upload content that:

• You do not have the right or permission to upload or share
• Infringes another person's copyright, intellectual property rights or privacy
• Is unlawful, fraudulent or misleading
• Is threatening, abusive or intended to harass another person
• Contains malicious software or material designed to interfere with the operation or security of The Sights
• Is otherwise prohibited by applicable law

We may remove or restrict access to content where reasonably necessary to comply with law, protect users, respond to a legitimate complaint, or protect the security or operation of The Sights.

7. Event Pricing and Payments

The price of an event will be displayed before you complete your purchase.

Payments are processed through Stripe or another payment provider made available by The Sights.

Your event will only become fully available after the required payment has been successfully processed.

Prices are shown in Australian dollars unless otherwise stated.

We may change the price of future purchases or extensions. A price change will not alter a purchase you have already completed.

8. Gallery Period and Extensions

A purchased event gallery is available for the period displayed as part of the service.

The Sights currently provides event galleries for 30 days, subject to any extension purchased by the event host.

Where available, an event host may purchase an additional 30-day extension.

If an active gallery is extended, the additional period is added to its existing expiry period. An expired gallery may also be reactivated where an extension option remains available.

Extension pricing will be displayed before the extension is purchased.

9. Expiry, Downloads and Deletion

Event hosts are responsible for downloading and securely backing up any photos they wish to keep.

Access to an event gallery is restricted after its expiry date. Guests will no longer be able to upload photos to the expired event, and the event host will no longer have normal access to the gallery unless it is extended.

Following expiry, uploaded event photos are retained for a 30-day grace period before they become eligible for permanent deletion.

During this 30-day grace period, an event host may be offered the option to purchase a gallery extension. If an extension is successfully purchased before the photos are permanently deleted, the gallery will be reactivated and the updated expiry date will apply.

The 30-day grace period does not extend normal access to the event gallery. Its purpose is to provide a limited recovery period before uploaded event photos are permanently deleted.

After the 30-day grace period has ended, uploaded event photos may be permanently deleted from The Sights' storage systems.

Once content has been permanently deleted, it cannot be recovered through The Sights.

10. Cancellations and Refunds

If you experience a problem with a purchase, please contact The Sights so that we can investigate the issue.

Any refund or remedy will be handled in accordance with these Terms and your rights under applicable Australian consumer law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

11. Acceptable Use

You must not misuse The Sights or interfere with its normal operation.

This includes attempting to:

• Gain unauthorised access to another user's account or event
• Bypass access controls, payment requirements or gallery restrictions
• Probe, scan or exploit security vulnerabilities
• Introduce malware or harmful code
• Use automated systems to place unreasonable load on the service
• Use The Sights for an unlawful purpose

We may suspend or restrict access where we reasonably believe the service is being misused or where necessary to protect The Sights or its users.

12. Availability of The Sights

We aim to keep The Sights available and reliable, but uninterrupted access cannot be guaranteed.

The service may occasionally be unavailable due to maintenance, updates, technical failures, internet outages or issues involving third-party infrastructure providers.

We may modify, update or temporarily suspend parts of the service where reasonably necessary for maintenance, security or development.

13. Third-Party Services

The Sights relies on third-party services to provide parts of the platform.

These may include services such as Supabase for backend infrastructure and storage, Stripe for payment processing, and Netlify for website hosting and delivery.

Third-party services may be subject to their own terms, privacy policies and availability.

14. Intellectual Property

Except for user-uploaded content, the website, branding, design, software, text, graphics and other material forming part of The Sights are owned by us or used with permission and are protected by applicable intellectual property laws.

You may use The Sights for its intended purpose, but you must not copy, reproduce, sell or commercially exploit our website, software or branding without permission.

15. Liability

To the extent permitted by law, The Sights is not responsible for loss caused by matters outside our reasonable control, including internet failures, third-party service outages, device failures or content uploaded by users.

You are responsible for maintaining your own copies and backups of important photos.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

16. Privacy

Our collection, use and handling of personal information is described in our Privacy Policy.

By using The Sights, you acknowledge that information will be handled as described in that policy.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to The Sights, our business, legal requirements or the way the service operates.

The latest version will be published on this page with the date it was last updated.

18. Governing Law

These Terms are governed by the laws applicable in South Australia, Australia.

Nothing in these Terms limits any rights you may have under applicable Australian law.
